Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the mobile applications of DayOff (“we”, “us”, or “our”), a sole proprietorship operated by Robin Atalan. They cover yawn and Orka (each an “App”).

By downloading, installing, or using an App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Use of the Apps

You may use our Apps for personal, non-commercial purposes only. You agree not to:

• Use an App for any unlawful purpose.
• Attempt to gain unauthorized access to an App or its systems.
• Reverse engineer, decompile, or disassemble any part of an App.
• Use an App to distribute malware or harmful content.
• Reproduce, distribute, or create derivative works based on an App.

Accounts

yawn creates an anonymous account in the background; no personal details are required. Orka lets you create an account using Sign in with Apple, or use the App without an account. You are responsible for maintaining the security of your account and for all activities that occur under it.

Subscriptions and Payments

Our Apps offer optional subscriptions that unlock premium features. By subscribing, you agree to the following:

• Payment: Subscriptions are billed through Apple’s App Store. All payments are processed by Apple and subject to the Apple Media Services Terms and Conditions.
• Free Trial: We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
• Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies.

Terms Specific to yawn

Health and Safety

yawn asks you to perform physical exercise. You do so at your own risk. The App is not a medical device and gives no medical advice. Consult a doctor before starting any exercise routine, especially if you have an injury, a heart condition, are pregnant, or have any other condition that could make exercise unsafe. Stop immediately if you feel pain, dizziness, or discomfort. Do not use the App while driving or in any situation where physical activity would be unsafe.

Alarms Are Not Guaranteed

yawn schedules alarms through Apple’s AlarmKit and depends on iOS, your device settings, sufficient battery, and the permissions you have granted. We cannot guarantee that an alarm will ring in every circumstance. Do not rely on the App alone for anything where missing a wake-up would cause harm or loss – keep a second alarm for safety-critical mornings.

Terms Specific to Orka

Third-Party Video Content

Orka displays an ongoing feed of short videos sourced from third-party platforms (such as YouTube). This content is created by third parties, remains the property of its respective owners, and does not represent our views.

There is zero tolerance for objectionable content or abusive behavior. By using the App, you agree not to promote, request, or distribute content that is illegal, hateful, harassing, violent, sexually explicit, or otherwise objectionable, and you acknowledge that such content is strictly prohibited.

To keep the community safe, the App lets you:

• Report any video you find objectionable, directly from the feed.
• Block a video or creator, which immediately removes that content from your feed.

We review all reported content and will remove objectionable content and, where applicable, eject the responsible content provider within 24 hours. We reserve the right to remove any content and to terminate access for users who violate these Terms.

AI-Generated Content

Orka uses artificial intelligence (OpenAI) to generate word explanations and translations. AI-generated content is provided for educational purposes only and may not always be accurate. We do not guarantee the correctness of AI-generated explanations.

Intellectual Property

Our Apps, including their design, code, content, and features, are owned by us and protected by intellectual property laws.

Disclaimer of Warranties

The Apps are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that an App will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of an App, including missed alarms and injuries sustained while performing a mission.

Termination

We may terminate or suspend your access to an App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date. Continued use of an App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
